In order to discourage Washington drivers from operating on our highways and roads while distracted, the Washington legislature in 2008 enacted two statutes that prohibit the use of a cellular telephone or texting while driving.
Washington Distracted Driving Accidents
RCW 46.61.667 prohibits the use of a wireless telephone while driving, except when the device is in a hands-free mode, to report illegal activity, to call for medical or emergency assistance, or to prevent injury to person or property. Similarly, RCW 46.61.668 prohibits the sending, reading, or writing of text messages while driving. The violation of these statutes is a traffic infraction and may provide a basis for liability when a crash occurs and people sustain injuries. Under Washington law, violation of a statute is evidence of negligence.
